Real Estate Litigation

Disputes over development rights, purchase contracts, and leases require counsel with in depth understanding of real property law, easements rights, landlord-tenant relationships, and the rights and obligations of adjacent landowners. Practicing in both state and federal courts throughout the country, MGKF attorneys represent clients in many types of real estate-related litigation, particularly when environmental issues play a role in the dispute.

Representative real estate litigation matters handled by firm attorneys include:

  • prosecution of construction claims resulting from unforeseen environmental conditions;
  • representation of manufacturers in plant closure cases involving the restoration of facilities in compliance with lease terms;
  • defense of manufacturers of asbestos-containing building materials in property damage litigation;
  • representation of landlords, tenants and subtenants in a variety of disputes concerning easement and lease interpretation and enforcement;
  • prosecution of injunction proceedings involving protestors' access to private property;
  • representation of supermarkets and other "big box" stores in cases involving shopping center design, development, and renovation;
  • representation of entities in cases involving the dissolution of partnerships and joint ventures holding and/or developing real property.
The experience of MGKF's attorneys in the real estate litigation field is not limited to the courtroom. Many of our attorneys are long-time members of organizations such as the Urban Land Institute and the International Council of Shopping Centers, regular contributors to real estate industry publications, and speakers at regional and national conferences.
