Biography:
Todd Kantorczyk has extensive experience advising clients on issues related to regulatory compliance, litigation, and transactional matters, particularly in the areas of air, climate change, and energy, including issues related to natural gas production in the Marcellus Shale. He has represented industrial and commercial concerns, ranging from Fortune 100 corporations to closely held entities, in complex matters including the following:
- resolution of compliance, permitting and enforcement issues for a major petroleum refinery that implicate New Source Review, New Source Performance Standards, and National Emissions Standards for Hazardous Air Pollutants;
- defense and resolution of federal and state air quality enforcement actions and negotiation of consent decrees and administrative consent orders covering various complex industrial operations including steel manufacturing;
- advice on cutting edge, complex air and waste issues affecting natural gas production in the Marcellus Shale, including single source aggregation, nonroad engine operation, GHG reporting, and beneficial reuse of flowback water and other drilling fluids;
- coordination of environmental response activities under an indemnity agreement at dozens of industrial sites worldwide;
- negotiation of a consent order with EPA in response to alleged Clean Water Act violations at a petroleum marketing terminal;
- compliance, policy and funding issues with respect to potential regulation of greenhouse gases and alternative energy production at the federal, state, and local level;
- appeals of construction permits before the Pennsylvania Environmental Hearing Board for municipal waste concerns;
- assistance to a commercial developer in understanding and shaping the potential impact of initiatives under Pennsylvania's Climate Change Action Plan;
- negotiations with state regulatory authorities with respect to air permit language and conditions, including construction permits and Title V operating permits;
- preparation of periodic reports, including Title V semi-annual deviation reports and annual compliance certifications;
- advice to clients on environmental issues and risk related to transactions with market values up to several million dollars; and
- defense of toxic tort claims, including private nuisance claims against a waste disposal company and personal injury claims against a Fortune 100 defense contractor.
Todd has also lectured and written on issues of climate change and alternative energy for The Legal Intelligencer, the Pennsylvania Bar Institute's Environmental Law Forum, the Philadelphia Lawyer, and other publications and organizations. He has been listed in Pennsylvania Super Lawyers as a "Rising Star" in the category of environmental law in 2007, 2008 and 2010.
Before joining Manko, Gold, Katcher & Fox LLP, Todd was an attorney in the Environment and Natural Resource Practice Group at Gibson, Dunn & Crutcher, LLP, in Washington, D.C. In law school, Todd was comments editor of the UCLA Law Review.
Todd currently serves on the Tredyffrin Township Environmental Advisory Committee. He is also a volunteer coach for the Devon Stratford Little League and is an alumni class officer for the Cornell University Class of 1992.
