Biography:
Robert D. Fox has over twenty years of experience providing compliance counseling for business and industry regarding hazardous and municipal waste regulations, Superfund matters, water regulation, and storage tank issues; assisting with the environmental aspects of corporate and real estate transactions and real property development, including brownfield redevelopment and wetlands, stormwater, and sewer capacity permitting; and litigating environmental matters before federal and state courts and administrative agencies. Examples of Robb’s representative matters include the following:
- compliance and permitting issues for a national solid waste corporation;
- compliance and permitting issues for a national hazardous waste recycler;
- compliance, permitting and site remediation for regional petroleum suppliers, retail gasoline station operators, and convenience store operators;
- all aspects of storage tank regulation and remediation;
- brownfield redevelopment and funding for national and regional industrial, commercial, and residential developers and investment companies;
- drafting comments for companies and trade associations on proposed federal and state environmental rulemakings;
- liability, remedy selection, allocation, and natural resource damage issues for potentially responsible parties at federal Comprehensive Environmental Response, Compensation and Liability Act ("CERCLA" or "Superfund") and Resource Conservation and Recovery Act ("RCRA") corrective action sites in Pennsylvania, New Jersey, New York, Delaware, Maryland, Massachusetts, Connecticut, Ohio, Iowa and Georgia;
- acquisition and divestiture of national and multi-national corporations or divisions of national and multi-national corporations, including agreement drafting and environmental due diligence;
- Superfund litigation involving successor liability, unilateral orders, remedy selection, consent decree enforcement, allocation, and private party liability issues;
- class action defense relating to property damage and annoyance and inconvenience;
- defense of toxic tort matters involving personal injury and property damage claims;
- all aspects of administrative appeals before the Pennsylvania Environmental Hearing Board and United States Environmental Appeals Board, including permit appeals, enforcement matters, and challenges to agency regulations and actions;
- all aspects of appellate practice, including appearing before all Pennsylvania appellate courts, the United States Supreme Court, and the Second and Third Circuit Courts of Appeal; and
- drafting and assisting in the passage of the 2002 brownfields amendment to the federal Superfund law on behalf of a national trade association.
Robb is the managing partner of the firm. He is a frequent lecturer at environmental conferences, including the annual ALI/ABA environmental conference in Washington, DC, and has written on a variety of topics, including Superfund cost recovery and contribution, Superfund allocation, storage tank litigation, environmental due diligence, municipal waste regulations, brownfields development, and ethical issues.
Robb is the Thomas A. O’Boyle adjunct professor at the University of Pennsylvania School of Law, a Summer Lecturer at Vermont Law School, and a Lecturer-in-Law for the Temple University Master of Law program in Beijing, China. He has been listed in the Best Lawyers in America since 2001, and listed as a Super Lawyer in Philadelphia and a Top 100 Lawyer in Pennsylvania since 2003.
Robb served as the chairperson of the Philadelphia Academies, Inc. and of the Lower Merion Conservancy, served as a board member of the Natural Lands Trust and a hearing officer of the Disciplinary Board of the Pennsylvania Supreme Court, and serves as a board member of the Delaware Valley Earth Force and the Friends of Andrew J. Fox Melanoma Foundation at the Abramson Cancer Center. He also served as chairman of the Lower Merion Township Planning Commission and as president of both the Delaware Valley Environmental Inn of Court and the Environmental Law Network. He currently serves on the Lower Merion Township Zoning Board and the Men's Roundtable and Board of Trustees of the Jewish Federation of Greater Philadelphia.
