Biography:

Kate Vaccaro has experience advising clients on issues related to regulatory compliance, litigation, and transactional matters, particularly in the area of air quality. She has represented industrial and commercial entities, ranging from Fortune 500 corporations to closely held companies, as well as municipalities, in complex matters involving the following:
  • appealing Title V operating permits before the New Jersey Office of Legal Affairs for a major petroleum refinery, implicating New Source Review ("NSR"), New Source Performance Standards ("NSPS"), and National Emission Standards for Hazardous Air Pollutants ("NESHAPs");
  • appealing construction permits before the Pennsylvania Environmental Hearing Board;
  • drafting comments on proposed federal and state regulations and draft permits;
  • preparing periodic reports, including Title V semi-annual deviation reports and annual compliance certification reports;
  • defending state enforcement actions and negotiating administrative consent orders involving federal and state regulatory compliance issues;
  • challenging NESHAP applicability determinations by the U.S. Environmental Protection Agency;
  • counseling on compliance, applicability, and permitting issues involving emergency generators, including NSPS for stationary compression ignition internal combustion engines; and
  • advising on compliance and applicability issues involving the federal Clean Air Interstate Rule ("CAIR") and the Acid Rain Program.

Kate has also written on the regulation of fine particulate matter. She was a summer associate with the firm in 2003. In law school, Kate was a staff member of the Temple Law Review.
