Administrative Appeals
When a client receives an order, penalty assessment, or other final administrative action from the U.S. Environmental Protection Agency ("EPA") or a state or local environmental regulatory agency, or is denied a permit, receives an unacceptable permit, or wishes to challenge another facility's permit, we are frequently called upon to pursue an administrative appeal. MGKF has represented our clients before the Pennsylvania Environmental Hearing Board, New Jersey Office of Administrative Law, City of Philadelphia, Allegheny County Health Department, and EPA's Office of Administrative Law Judges on numerous occasions. Often these matters evolve into full-blown litigation before these administrative tribunals with extensive depositions and other discovery, motion practice, and ultimately trial or hearing.
